Personal Injury claims do not consist of solely whiplash from car accidents. There are many types of injuries which may give rise to a claim.. All claims for personal injury must be processed via the Injuries Board www.piab.ie, an independent State body which assesses compensation levels. A Plaintiff (called an Applicant) fills out a form, attaches a medical and pays a small fee. The Injuries Board will write to the parties listed by the Applicant as being those whom the Applicant believes is responsible or liable for the injuries suffered.
Injuries Board takes no interest in fault; it is up to the Defendants (the "Respondents") to accept or reject the Injuries Board process. Equally, Injuries Board does not carry out any investigations into the incident or the Plaintiff, except, in some limited circumstances, to send them for medical examination.
